Customer Agreement and Booking Agency Terms & Conditions

Except where otherwise specified, we, EverBlue Expeditions LLC, a company registered in the Commonwealth of Massachusetts, with our principal business address at 1 Central St. Suite 205 Middleton, MA 01949 (“EverBlue Expeditions,” “we,” “us,” “our”), act only as a booking agent in respect of all bookings we take and/or make on your behalf. We accept no liability in relation to any contract you enter into or for any travel arrangements or other services you purchase (“Arrangements”) or for the acts or omissions of any supplier, local operator, or other person(s) or party(ies) connected with any arrangements. For all Arrangements, your contract will be with the supplier of the Arrangements in question (the “Supplier/Principal”).

By making a booking with us, the first named person on the booking agrees on behalf of all persons listed in the booking that they:

  1. a) Have read these Agency Terms & Conditions and agree to be bound by them;
    b) Consent to our use of personal data in accordance with our Privacy Policy and are authorized on behalf of all persons named on the booking to disclose their personal details to us, including, where applicable, special categories of data (such as health conditions, disabilities, or dietary requirements);
    c) Are over 18 years of age and, where placing an order for services with age restrictions, declare that they and all members of their party are of the appropriate age to purchase those services;
    d) Accept financial responsibility for payment of the booking on behalf of all persons listed on the booking.

1. Contract Formation

When making your booking, we arrange for you to enter into a contract with the applicable Supplier/Principal (e.g., local operator) of the Arrangements, as specified in your booking confirmation. As a booking agent, we accept no responsibility for the acts or omissions of the Supplier/Principal or the services they provide.

Your booking with us is subject to these Agency Terms & Conditions and the specific terms and conditions of the relevant Supplier/Principal(s) you contract with. We will provide a link to the Supplier/Principal’s terms and conditions upon confirmation of your booking. These terms may limit or exclude the Supplier/Principal’s liability to you.

Your booking is confirmed, and a contract between you and the Supplier/Principal will exist when we send you a confirmation on their behalf.

2. Booking Accuracy

Please verify that all names, dates, and details on your booking documents are accurate upon receipt and notify us of any discrepancies immediately. The booking information you provide will only be shared with relevant parties involved in the provision of your Arrangements. This includes government or regulatory authorities if required by law. Failure to provide accurate details may result in an inability to fulfill your booking.

3. Payment

To confirm your booking, you must pay a deposit or the full payment as specified by the Supplier/Principal. The balance must be paid by the due date noted in your confirmation. Failure to make payments on time may result in cancellation and the application of cancellation fees per the Supplier/Principal’s terms.

Payments processed through U.S. banks may be subject to applicable transaction or foreign exchange fees, which are the responsibility of the customer.

4. Pricing Adjustments

We reserve the right to correct errors in advertised or confirmed pricing. Suppliers/Principals may amend their pricing due to changes in taxes or government-imposed fees, for which we accept no liability.

5. Insurance Requirement

You are required to secure travel insurance that covers trip cancellation, medical expenses, repatriation, and supplier insolvency. Without adequate insurance, you assume full responsibility for all losses arising from circumstances that would otherwise be covered.

6. Changes and Cancellations by You

All cancellation or amendment requests must be submitted in writing to [email protected]. Acceptance of such requests is subject to the terms and conditions of the Supplier/Principal. Cancellation or amendment fees may apply, including a $100 administration fee payable to EverBlue Expeditions LLC. Please note: Some Supplier/Principals do not allow changes and therefore full cancellation charges will apply.

7. Supplier/Principal Cancellations or Changes

If a Supplier/Principal cancels or materially changes your booking, we will notify you promptly and assist in making alternate arrangements. However, our liability is limited to the services explicitly provided by EverBlue Expeditions LLC.

8. Our Responsibilities

Our role is limited to booking services on your behalf as instructed. We do not own, operate, or control any travel-related services or suppliers. EverBlue Expeditions LLC assumes no responsibility for service failures, delays, or incidents caused by third parties, force majeure events, or other factors beyond our control.

Your contract is with the Supplier/Principal, and its booking conditions apply. EverBlue Expeditions LLC is an independent contractor and is not an employee, agent, or representative of any suppliers regarding the performance of your contract. We do not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel, restaurant, or any other entity providing services related to your trip. Additionally, we are not affiliated with any other tour operator.

All suppliers are independent contractors and are not employees, agents, or representatives of EverBlue Expeditions LLC. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier. By accepting these documents or utilizing the services, you agree that EverBlue Expeditions LLC, including its employees, agents, or representatives, is not liable for any loss, injury, or damage to any trip participant or their belongings, or otherwise, in connection with any service provided or not provided, resulting directly or indirectly from any event beyond our control.

We assume no responsibility for delays, schedule changes, loss, injury, or damages resulting from acts or omissions by others. Additionally, we are not liable for events such as strikes, labor disputes, acts of God or government, fires, wars (declared or not), terrorism, insurrection, riots, theft, epidemics, illness, physical injury, quarantine, medical or customs or immigration regulations, delays, or cancellations. We also accept no responsibility for lost or stolen items.

As your booking agent, our responsibilities are limited to facilitating the booking in accordance with your instructions. EverBlue Expeditions LLC accepts no responsibility for the actual provision of services or arrangements by third-party suppliers. Furthermore, any information about the arrangements provided by us is shared in good faith, and we accept no liability for its accuracy. We reserve the right to refuse any participant or potential participant at our sole discretion.

9. International Travel Requirements

It is your responsibility to ensure compliance with all passport, visa, and health requirements for travel. EverBlue Expeditions LLC is not liable for any failure to meet these requirements or for any associated losses.

10. Governing Law and Dispute Resolution

This agreement is governed by the laws of the Commonwealth of Massachusetts. Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Massachusetts.

11. Complaints and Claims

If you have a complaint regarding the services provided, it must first be addressed to the Supplier/Principal while the issue occurs. For complaints regarding our booking service, please contact EverBlue Expeditions LLC directly within 14 days of your return.
